Article 1 of the Law of Ukraine "On Copyright and Related Rights" provides for such a concept as a derivative work. This is a work that is a creative adaptation of another existing work without prejudice to its protection (annotation, adaptation, arrangement, processing of folklore, other processing of a work) or its creative translation into another language. At the same time, Article 20 of the same Law establishes that translators and authors of other derivative works have the copyright to the translation, adaptation, arrangement or other processing carried out by them (provided they comply with the rights of the author whose work was translated, adapted, arranged or otherwise processed). The copyright of translators and (or) authors of other derivative works does not prevent other persons from making their own translations and adaptations of the same works. It is a separate object of copyright and registration is carried out at the author's request. In case of registration of a derivative work, the register indicates that the work is derivative. In addition, the author has the right to use the derivative work at his discretion - for example, to allow other publishers to publish or use it in other ways.
A derivative work is a separate object of copyright, and its use does not entail legal liability and does not violate the rights of the author of the work on the basis of which the derivative work was created.
